Welcome to NOVA™. These Terms and Conditions ("Terms") govern your access to and use of the NOVA platform, including any content, functionality, and services offered through NOVA ("Service"). Please read these Terms carefully before using the Service.

1. Acceptance of Terms

By accessing or using NOVA, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service. If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

2. Description of Service

NOVA is an AI-powered defence training intelligence platform that assists users in creating training documentation aligned with defence training frameworks including UK DSAT (JSP 822), US TRADOC, NATO Bi-SC 75-7, and ASD/AIA S6000T. The Service provides:

• Training Needs Analysis (TNA) assistance
• Training design document generation
• Lesson plan and course schedule creation
• Assessment strategy development
• Quality assurance documentation support

3. User Accounts

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account

4. Authorised Use

Access to NOVA is restricted to authorised personnel only. You must have appropriate clearance and authorisation from your organisation to use this Service for defence training purposes. Unauthorised access or use is strictly prohibited and may result in civil and criminal penalties.

5. AI-Generated Content

NOVA uses artificial intelligence to generate training documentation and recommendations. You acknowledge and agree that:

• Human Review Required: All AI-generated outputs must be reviewed, validated, and approved by qualified personnel before use in official training programmes
• No Guarantee of Accuracy: While NOVA strives for doctrinal accuracy, AI-generated content may contain errors or omissions
• Professional Judgement: AI outputs are intended to assist, not replace, professional training design judgement
• Compliance Responsibility: You are responsible for ensuring all outputs comply with applicable regulations, policies, and doctrine

6. Intellectual Property

Our Content: The Service and its original content, features, and functionality are owned by NOVA and are protected by international copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of any content you upload to the Service. By uploading content, you grant NOVA a limited licence to process that content solely to provide the Service to you.

Generated Outputs: Training documents generated through the Service are owned by you, subject to any applicable third-party rights in source materials.

7. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable laws, regulations, or government policies
• Process classified or sensitive information beyond your authorisation level
• Attempt to gain unauthorised access to any portion of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service for any purpose other than legitimate defence training development
• Share access credentials or allow unauthorised persons to access your account

8. Data Security

We implement appropriate technical and organisational measures to protect the security of your data. However, no method of transmission over the Internet or electronic storage is 100% secure. You are responsible for maintaining the security of your own systems and credentials.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOVA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify, defend, and hold harmless NOVA and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Service or violation of these Terms.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the modified Terms.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
